b. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account/s.

f. You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

g. We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:

We have the right at our sole discretion to remove any content that we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

h. We do not assume any liability for any content posted by you or any other 3rd party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of Richard Yu Ventures, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our privacy policy.

i. You agree to indemnify and hold harmless Richard Yu Ventures and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such an event, you shall provide us with such cooperation as is reasonably requested by us.

You agree to pay, and authorize Richard Yu Venture’s third party payment processor to charge using your selected payment method, for all applicable fees and taxes to use our Services or purchase our products. All fees are in US Dollars. Richard Yu Ventures is not responsible for charges, import charges, bank fees, or foreign exchange rates applied by your Credit Card Company and/or financial institution. You are responsible for providing complete and accurate billing and contact information to us.

This guarantee is the ONLY refund policy that Richard Yu Venture's High Performance Training Program offers. 

This guarantee states that if the customer has taken action on EVERY SINGLE assignment within The High Performance Training Program, and still is not satisfied with the results obtained from the High Performance Training Program, from a STRICTLY productivity/time management perspective, then the customer may request for a refund according to the following conditions.

To qualify for the refund the student must submit proof IN FULL COMPLETION of the following things:

 

--100% completion and viewership of all 8 week’s worth of modules (Our system can track to see how much of a certain video was watched. It must show a 100% viewership completion on our software in order for this to be qualified as complete).

--100% completion and viewership of all 8 week’s worth of Q/A recordings. 

--100% completion of each week’s assignment worksheets (Includes Weekly Performance Evaluation, in addition to each week’s assignment modules).

--Each of these worksheets is required to be printed, in order for the student to qualify for this refund. 

--8 screenshots of a WEEKLY zoom call that was held between the customer, and another student within the High Performance Training Program Facebook group. Each week’s zoom call must be with a ENTIRELY SEPARATE student. Should there be any repeats in the people involved on these weekly calls, then this guarantee is no longer valid for the customer

--100% attendance for 8 weeks of LIVE Q/As. The customer must provide dated screenshots of attendance to each of these 8 LIVE Q/As in order to qualify for the refund. If the student misses one of these Q/As, the student must provide evidence that the replay of the Q/A was watched completely.

--In order to qualify for the refund, the student MUST have commented on each Accountability Post (Monday, Wednesday, and Friday) for the duration of the entire 8 weeks, for a total of 24 posts. The student must have asked at least one question per week, and provide proof of evidence by providing screenshots from the FB group, to demonstrate that at least one question was asked per week, on a Monday/Wednesday/Friday Accountability Post. 

--If the customer fails to comment on a single Accountability post, this refund is no longer valid for that customer.

Should the student fail to provide any one of the above following items, then the student’s 150% Performance Money-Back Guarantee is then declared voided, and no longer valid. NO REFUND shall be given to a customer, other than through the conditions stated above.

This guarantee is the ONLY refund policy that Richard Yu Venture's High Performance Mastery Program offers. 

This guarantee states that if the customer has taken action on EVERY SINGLE assignment within The High Performance Mastery Program, and still is not satisfied with the results obtained from the High Performance Mastery Program, from a STRICTLY productivity/time management perspective, then the customer may request for a refund according to the following conditions.

To qualify for the refund the student must submit proof IN FULL COMPLETION of the following things:

 

--100% completion and viewership of all 6 month's worth of modules (Our system can track to see how much of a certain video was watched). 

--100% completion and viewership of all 6 month's worth of Q/A recordings. 

--100% completion of each week’s assignment worksheets (Includes Weekly Performance Evaluation, in addition to each month's assignment modules).

--A printed version of the High Performance Mastery Accountability Checklist must be printed, and fully filled out and submitted.

--Each of these worksheets is required to be printed and FULLY completed, in order for the student to qualify for this refund. 

--6 screenshots of a MONTHLY zoom call that was held between the customer, and another student within the High Performance Training Program Facebook group. Each month's zoom call must be with a ENTIRELY SEPARATE student. Should there be any repeats in the people involved on these monthly calls, then this guarantee is no longer valid for the customer

--100% attendance for 24 weeks of LIVE Q/As. The customer must provide dated screenshots of attendance to each of these 24 LIVE Q/As in order to qualify for the refund. If the student misses one of these LIVE Q/As, then the Performance Guarantee is now voided. 

--On each of the LIVE Q/As, the student must provide evidence that he/she has asked at least one question on EACH LIVE Q/A, for a minimum of 24 questions asked in total over the course of the program. 

--In order to qualify for the refund, the student MUST have commented on each Accountability Post (Monday, Wednesday, and Friday) for the duration of the entire 24 weeks, for a total of 72 posts. The student must have asked at least one question per week, and provide proof of evidence by providing screenshots from the FB group, to demonstrate that at least one question was asked per week, on a Monday/Wednesday/Friday Accountability Post. 

--If the customer fails to comment on even a single Accountability post, this refund is no longer valid for that customer.

ONLY students who choose the monthly recurring payment option may choose to cancel payments for High Performance Mastery program. 

If a student cancels before the full completion of the 6 months of the program, the student will lose access to the bonuses and the modules of High Performance Mastery. 

Only students who pay in full for the entire 6 months are allowed to gain life-time access to the full High Performance Mastery Modules.

This guarantee states that if the customer has taken action on EVERY SINGLE assignment within The High Performance Technology Acceleration Package, and still is not satisfied with the results obtained from a STRICTLY productivity/time management perspective, then the customer may request for a refund according to the following conditions.

To qualify for the refund the student must submit proof IN FULL COMPLETION of the following things:

 

--100% completion and viewership of all 4 modules (Our system can track to see how much of a certain video was watched. It must show a 100% viewership completion on our software in order for this to be qualified as complete).

--Full Implementation of each "Action Item" assignment, including, but not limited to: 

--Full Trello Board Set Up, with 3 MITs, and at least 5 tasks transferred to the board. 

--The student must have used the Trello board for minimum of 14 days according to how it was taught. 

--The student must have installed and executed on Cold Turkey and FB Feed Eradicator softwares for a minimum of 14 days according to how it was taught. 

--The student must have set up Google Calendar and used it for a minimum of 14 days according to how it was taught. 

--The student must have integrated Calendly, and used it for at least 3 different appointment bookings and provide proof of this.

This product has two payment versions, a paid in full and a monthly option. For both payment options, this product has a strict No Refund policy.

The lifestyle package is a LIFETIME access program, which means that the customer will continue to receive coaching from Richard and his team as long as Richard Yu Ventures continues in business. 

The monthly package can be cancelled at any time. 

You agree that you will not:

Access the membership area of the site corresponding to the High Performance Training Program for any of these purposes:

Attempt to access another member’s account.

Attempt to download content from the site through the use of any software, agent, or device (including spiders, robots, crawlers, data mining tools or the like) other than the material made explicitly available to you via download.

Your privacy is very important to us, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. By using our website, you understand and agree that all Resources we provide are “as is" and “as available”. This means that we do not represent or warrant to you that:

i) the use of our Resources will meet your needs or requirements.

ii) the use of our Resources will be uninterrupted, timely, secure or free from errors.

iii) the information obtained by using our Resources will be accurate or reliable, and

iv) any defects in the operation or functionality of any Resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.

vi) no information or advice, whether expressed, implied, oral or written, obtained by you from Richard Yu Ventures or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Richard Yu Ventures will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

All content and materials available on highperformancetrain.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Richard Yu Ventures, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Richard Yu Ventures.

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

This website is controlled by Richard Yu Ventures. It can be accessed by most countries around the world. By accessing our website, you agree that the statutes and laws of our state, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Richard Yu Ventures currently operates from Los Angeles, California. 

If you choose to access and use our Services from another location, country or jurisdiction, you are responsible for compliance with local laws, if and to the extent local laws are applicable. Nothing in these Terms of Use shall be deemed to affect any statutory or other consumer rights that you may have under local laws which cannot be or have not been altered, limited or waived by these Terms of Use. You might wish to consult with a legal professional in your own jurisdiction about the exact implications of these Terms of Use.

Regardless of any statute or law to the contrary, any claim or cause of action against Richard Yu Ventures arising out of or related to your use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred.

If you have a dispute with one or more of our other Clients, you release Richard Yu Ventures from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
